Sphn Data Transfer Agreement

In order to be able to exchange data and models of research projects between institutions, a Data Transfer and Use Agreement (DTUA) and/or a Material Transfer Agreement (MTA) is required. As part of a national harmonisation effort, SPHN and SBP have developed joint models for both documents, in collaboration with Swiss universities, eth domain institutes and university hospitals. You can find the details in the newsletter published today. An MBA must be concluded between legal persons that are supposed to be bound by the provisions of the treaty, and not between individual scientists involved in the transfer and the research associated with it, as they may not be able to ensure the performance of contractual obligations. The proprietary information or materials to be transmitted can usually be defined. The transfer date can also be set. A material transfer contract documents the protected information, equipment or materials transferred between the parties for the applied research project, when they are to be transferred, under what conditions, when and how the material is returned to its owner (if this is the case). The conditions of use can also be defined. Material transfer clauses may also be included in broader cooperation, intellectual property rights or undisclosed agreements. . . .
